Mayor Bass Issues Emergency Executive Order to Prohibit SB 9 Applications Within Palisades Burn Area

Action Comes After Mayor’s Advocacy to Protect the Palisades

LOS ANGELES — Mayor Karen Bass today issued Emergency Executive Order 9 to prohibit Senate Bill 9 (SB 9) applications within a Very High Fire Hazard Severity Zone in the boundaries of the Palisades Fire area, aligning with Governor Gavin Newsom’s latest executive order.

“SB 9 was not originally intended to be used in the rebuilding of a community that was decimated by the worst natural disaster L.A. has ever seen,” said Mayor Karen Bass. “I thank Governor Newsom for working with my office to provide some sense of solace for a community working to rebuild.”

EMERGENCY EXECUTIVE ORDER NO. 9

Return and Rebuild

Issue Date: July 30, 2025

Subject:  Local Prohibition on SB 9 in Burn Areas

INTRODUCTION

On July 30, 2025, the Governor signed Executive Order N-32-25 to suspend the application of Senate Bill 9 (Government Code Sections 65852.21 and 66411.7) (“SB 9”) within the boundaries of the Palisades and Eaton Fires in Los Angeles County, subject to local agency discretion to elect to utilize SB 9 review in designated areas in whole or in part or not at all.

Consistent with the Governor’s latest order, this Emergency Executive Order No. 9 (EO9) is intended to declare the City’s review process for urban lot splits and two-unit developments in the Very High Fire Hazard Severity Zone within the boundaries of the Palisades Fire area.

Pursuant to City Charter Section 231, subsection (i), and under the provisions of Los Angeles Administrative Code Section 8.29 that authorize me to promulgate, issue and enforce emergency rules, regulations, orders, and directives, I hereby declare the following order to be necessary for the protection of life and property and I hereby order, effective immediately, that:

  1. The City of Los Angeles will not accept or process applications under Government Code Sections 65852.21 and 66411.7 for any project within a Very High Fire Hazard Severity Zone within the boundaries of the Palisades Fire area. 
  2. Notwithstanding anything to the contrary in Paragraph 1., nothing in this order is intended to affect a complete plan check application that is vested pursuant to LAMC CH 1A Section 13B.10.1.B.2(a) that was accepted prior to the issuance of the Governor’s Executive Order N-32-25.
